Terms and Conditions

ABYSS PLONGÉE is a company offering all activities related to scuba diving.

Scope of Application

These general terms and conditions of sale apply to all commercial relationships between clients (individuals and groups) and Abyss Plongée. A version of these terms and conditions is available on the website at the time the client makes a booking request for diving services with the center.

Any booking request made to Abyss Plongée implies full acceptance of these terms and conditions.

These terms shall prevail over any other general or specific conditions not expressly approved by Abyss Plongée. The company reserves the right to modify its terms at any time. In such a case, the applicable terms will be those in force on the date of the customer’s order.

Acceptance of the Terms and Conditions

By purchasing a service offered by Abyss Plongée, the client accepts these terms and confirms that they are aware of the contraindications to scuba diving and are fit to practice.

For any training course or exploration dive, the client must present, depending on the type of dive, a medical certificate of fitness for scuba diving issued within the last year. This requirement does not apply to introductory dives or discovery courses.

Minors must have parental authorization to participate in training or exploration dives.

 

Prices

All prices are expressed in euros (€), net of tax (VAT not applicable – Article 293 B of the French General Tax Code).

Abyss Plongée reserves the right to change its prices at any time. However, the price charged will be the one in effect on the website at the time of booking. The company may request proof of age for participants.

Bookings

To book a service, the customer must contact the center by phone at (+33) 467015054 or by email at contact@abyssplongee.com.

To confirm the booking, a deposit of at least 50% of the total cost is required. The balance must be paid on the day of the activity or the first session in case of multiple services.

Payments can be made by:

  • Phone payment (remote card payment)

  • Website

  • On-site (credit card, vouchers, cash)

Order confirmation implies acceptance of these terms and full acknowledgment of them, waiving any other purchasing conditions. All provided data and confirmation records serve as proof of the transaction.

Right of Withdrawal

Private individual customers booking via the website have a 7-day withdrawal period to cancel or request a refund without penalty, except for administrative and return fees.

After this period, no refund will be granted unless cancellation is made at least 48 hours before the scheduled activity.

Diving Services Content

Before participating, the client must ensure they have the required equipment or that the center can provide it (rental or loan). Missing optional equipment cannot justify cancellation.

Clients using their own equipment are not entitled to any discount.

Damage or Loss of Equipment

The client agrees to use all provided or rented equipment carefully and follow the instructor’s instructions.

Any equipment returned in a different condition than provided will be considered damaged. Abyss Plongée may charge the cost of repair or replacement. Normal wear and tear is excluded.

 

Activity Conditions

Abyss Plongée reserves the right to change the location of the activity if necessary.

 

Activity Schedule

Diving activities take place (unless otherwise stated) from late April to early October, between 08:30 and 19:30.

Meeting point: 21 impasse du globe, 34300 Cap d’Agde.

Late arrival by the client may result in the activity not being rescheduled. Failure to attend may result in forfeiture of deposits or full payment.

Client Obligations

The client must ensure they have all required certifications and documents (e.g., license, certification, medical certificate).

Clients using their own equipment are responsible for checking it before and after dives. If an instructor deems equipment unsafe, the client may be required to use center equipment or be refused participation.

Certification and Training Validation

Certification is not automatic and depends on successful completion of practical and/or theoretical assessments.

Abyss Plongée may refuse certification if the required level is not achieved. No refund will be issued in such cases.

Clients with Disabilities

Abyss Plongée does not discriminate against clients with disabilities. However, clients requiring special assistance (visual, hearing, physical, or cognitive) are asked to inform the center in advance.

Access to the boat may be difficult for individuals with mobility impairments.

Cancellation, Postponement, or Interruption

By the client:

  • 7-day withdrawal period for full refund

  • After this period, deposits are non-refundable

  • Cancellation less than 48 hours before = full charge

  • No refund for partially completed activities

For training or stays, no refund is given if the client interrupts or fails to attend. Clients are advised to purchase cancellation insurance.

For group bookings, no refund will be granted for unused dives, even due to weather.

By the diving center:
Activities may be canceled due to weather or technical reasons.

  • Weather: rescheduling may be offered; otherwise, no refund

  • Technical issues: rescheduling or refund for unused services

Any additional costs due to rescheduling remain the client’s responsibility.

Safety and Personal Belongings

Abyss Plongée is not responsible for loss, theft, or damage to personal belongings.

Activities for Children

Minors are under the responsibility of accompanying adults, except during activities where instructors are responsible.

Minimum age for a first scuba dive is 8 years.

Rules Within the Diving Center

Proper attire is required. Equipment and facilities must be used appropriately.

Liability

Clients are covered by civil liability insurance through Abyss Plongée during activities.

Clients are advised to take additional insurance (personal injury, equipment, cancellation).

The company is only bound by a best-effort obligation for online services and is not responsible for internet-related issues.

Complaints

Any complaint must be submitted within 7 days after the activity by email with supporting documents to: abyssplongee34@gmail.com

Jurisdiction

In case of dispute, the parties will seek an amicable solution. Failing that, the competent courts will be those under the jurisdiction of Béziers.
